Do I Need a Trust if I Own a Business?

What actually happens without a plan
If you die without naming who steps into your role, the business can be left without anyone authorized to sign contracts, access accounts, or make day-to-day decisions until a personal representative is appointed by the court. Partners, co-owners, and employees are left waiting. If your operating agreement or shareholder agreement does not address what happens to your interest on death, that uncertainty compounds.
Why a trust is often the better tool
A revocable living trust lets you transfer your business interest into the trust during your lifetime, with you as trustee, so nothing changes day to day while you are alive and able to run things. On your death or incapacity, a successor trustee you named steps in immediately, without waiting on the probate court. For a business, that continuity is the entire point. It is the difference between a successor who can sign a check on Monday and one who cannot act until a judge says so.
